The terms “we,” “us,” and “our” refer to Sketcha Designs, LLC. Sketcha Designs, LLC operates this store and website, including all related information, content, features, tools, products, and services to provide you with a curated shopping experience (the “Services”). Sketcha Designs, LLC is powered by Shopify, which enables us to provide the Services to you.

The terms below, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services. SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and you have the right to allow any minor dependents to use the Services on devices you own or manage.

To use the Services, including accessing or browsing our online stores or purchasing products or services, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 – OUR PRODUCTS

We provide:

Print-on-demand (POD) products through partners such as Printful, Redbubble, Printify, Teespring, and Amazon.
Surface design products, including digital files, patterns, and designs.
Custom graphic design services, including branding, illustration, and other commissioned work.
Future subscription-based design services.

We have made every effort to provide an accurate representation of our products and services. However, colors or product appearance may differ due to device settings, production processes, or supplier variations. Product descriptions and availability are subject to change without notice. We reserve the right to discontinue any product at any time and may limit quantities on a case-by-case basis.

SECTION 3 – ORDERS AND CLIENT RESPONSIBILITY

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order at our discretion. Orders are not accepted until we confirm acceptance and receive full payment. Please review your order carefully before submitting, as cancellation requests may not be accommodated after acceptance.

Graphic Design Services:

Clients are responsible for reviewing all proofs, drafts, and final files before use or production. Approval of final files indicates acceptance of responsibility for any errors, misprints, or omissions.
Custom/commissioned design services are non-refundable unless otherwise agreed in writing.

All purchases are subject to our Refund Policy [LINK]. You represent and warrant that your purchases are for personal, household, or agreed-upon business use and not for unauthorized commercial resale.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. Prices in effect at the time of order will be set out in your order confirmation. Unless expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges.

You agree to provide current, complete, and accurate purchase, payment, and account information. You represent that:

Payment information is true, correct, and complete;
You are authorized to use the payment method; and
You will pay all charges incurred at the posted prices, including applicable taxes, shipping, and handling.

SECTION 5 – SHIPPING AND DELIVERY

We are not liable for shipping and delivery delays. All delivery times are estimates only. We are not responsible for delays caused by carriers, customs, or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you.

SECTION 6 – INTELLECTUAL PROPERTY

All artwork, designs, patterns, and content on this website are the property of Sketcha Designs, LLC., its affiliates, or licensors and are protected by U.S. and foreign copyright and trademark laws.

Graphic Design Services:

Unless otherwise agreed in writing, we retain copyright of all commissioned designs. Clients receive a limited license for the agreed purpose only.
Unauthorized reproduction, distribution, modification, or commercial use of our designs is prohibited.

You may use the Services and content for personal, non-commercial purposes only. Unauthorized use may violate copyright, trademark, and other laws.

SECTION 7 – OPTIONAL TOOLS

Third-party tools offered through the Services are provided “as is” without warranties. Use of such tools is at your own risk and discretion. We are not liable for your use of third-party tools.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain third-party content and links. We are not responsible for the content or policies of third-party websites. Any transactions or issues with third-party services must be resolved directly with the third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Sketcha Designs. LLC is powered by Shopify. Any sales and purchases are made directly with Sketcha Designs, LLC. Shopify is not responsible for any aspect of sales, products, or services. You release Shopify from all claims, damages, and liabilities arising from purchases or transactions with Sketcha Designs, LLC.

SECTION 10 – PRIVACY POLICY

All personal information is subject to our Privacy Policy [LINK] and Shopify’s Privacy Policy. Use of the Services constitutes acknowledgment of these policies.

SECTION 11 – FEEDBACK

Any feedback submitted grants us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such feedback for any purpose. You represent that you own or have rights to submitted feedback and that it complies with these Terms.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders without notice.

Graphic Design Disclaimer:
While we strive for accuracy, we are not responsible for errors, misprints, or issues that arise after client approval of final files. Clients are responsible for proofing and approving all designs before production or use.

SECTION 13 – PROHIBITED USES

You may use the Services for lawful purposes only. Prohibited activities include:

Illegal or malicious activity;
Infringement of intellectual property;
Harassment, false information, spam, or malicious code;
Unauthorized collection of personal information;
Circumventing security features of the Services.

We may suspend or terminate accounts violating these Terms.

SECTION 14 – TERMINATION

We may terminate access to the Services at our discretion. Termination does not relieve you of obligations accrued prior to termination. Certain sections (Intellectual Property, Limitation of Liability, Indemnification, etc.) survive termination.

SECTION 15 – DISCLAIMER OF WARRANTIES

The Services and all products are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent allowed by law, Sketcha Designs, LLC and its partners, affiliates, and Shopify are not liable for any direct, indirect, incidental, punitive, or consequential damages, including lost profits, revenue, or data.

For POD items and surface design products, liability is limited to replacement or refund per our Refund Policy.

For graphic design services, liability is limited to delivery of agreed-upon digital files. We are not responsible for printing, production, or third-party use of designs after client approval.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Sketcha Designs, LLC., Shopify, and affiliates from any claims, losses, or damages arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

SECTION 18 – SEVERABILITY

If any provision is found unenforceable, it will be severed, and the remaining Terms remain in effect.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Failure to enforce any provision does not waive rights. These Terms and related policies constitute the entire agreement between you and Sketcha Designs, LLC.

SECTION 20 – ASSIGNMENT

You may not assign these Terms without our consent. We may assign without notice.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of Wisconsin. You consent to jurisdiction in its courts.

SECTION 22 – HEADINGS

Headings are for convenience only and do not affect interpretation.

SECTION 23 – CHANGES TO TERMS

We may update these Terms at any time by posting changes. Continued use of the Services constitutes acceptance of changes.
